First let me translate the lying headline:

Now let me translate the byline:

Legal experts: This shows that the verdict was too quick, and not logical.

I would like to analyze the distortion of truth in the headline.

 The lying "Zeitung" is in fact telling its naive audience that there was some positive aspect in the decision of the appeals court to throw out one of the charges and that the "legal world" was in shock because of it.

The truth is that the charge that was thrown out was the charge that Weingarten committed abuse during his travels between Belgium and Israel, and that charge was thrown out not because he didn't do it but solely because citizens cannot be found guilty in America for crimes committed oversees unless there's  "territorial nexus" to the United States.

The three-judge panel upheld other convictions covering abuse that took place during travel from Brooklyn to Belgium, and from Israel to Brooklyn.

The "Legal World" was not and  is not shocked by this, and this is not a positive sign because he will probably not get off any years from his sentence because of this development.

Because of space restraint I have decided to translate only some of the content of this article, but if my readers want I have no problem translating the entire article.

Translation of the first and part of the second paragraph of the article..

The legal media, for example the "Law Journal" reported with astonishment that the Appeals Court threw out a third of the charges, which shows that the verdict was not legally correct , and it also showed that the case had many holes and was not based on facts."

My analysis:

1.  The general media and the "Law Journal" didn't report this development with astonishment but reported this as it would any news that applies to the legal "world", that you cannot charge someone for crimes committed oversees unless there is "territorial nexus to the US."
2. The Appellate Court didn't find him innocent of that charge, they threw it out because of a technical law issue, and not because he didn't do it..

Loose Translation of the Third Paragraph of the Lying "Dee Zeiting"

"As was already reported, The New York State Appellate Court with a panel of three judges, Livingston, Wesley, and Cobrens, partially accepted the clear proof and the logic from the defense lawyers who submitted papers appealing the disgusting verdict, which sentenced Rebbi YM Weingarten Shlitah  to 30 years in a terrible jail. The court understood that the lower court was quick to sentence him to such a stringent sentence, they therefore threw out a part of that verdict, and took off 10 years jail time and reduced a third of his sentence ."


My analysis:
 It wasn't  the "New York State Appellate Court," it was  the United States Appellate Court based in New York State..

1. The reason the court threw out the charge was not because "they understood that the lower court was too quick to reach a verdict" but as we mentioned before, the Appellate Court ruled that the lower court had no jurisdiction to charge him with the crime of transporting his daughter from Belgium to Israel. They actually upheld the other charges!
2. The court did not as of February 1, 2011 reduce his sentence....
3. The Zeitung is lying when they report to their naive readers that the court already reduced the sentence.

The Appellate Court actually removed 10 years from his sentence, but it still hurts since it is like a "Torah Scroll in Pain," that such a Torah Scholar and G-D fearing person and a innocent person that was only a sacrifice to bitter factions, sits in such a bitter circumstance and the courts still didn't totally free him.


The new developments gives renewed strength, hope and spirit to the great Rabbis that are busy to redeem him "Pidyan Shevuiyim." The leader of these Rabbis is the Gaon and Righteous Rebbi Yitzchok Tuviah Weiss from Jerusalem, and the Gaon and Righteous Rabbi Moshe Green Shlitah, Rosh Yeshivah of Monsey.
Rosh Yeshivah who is in a terrible situation in a bitter jail in the far away Virginia.

My analysis:

1. I found a great Irony: Rabbi Moshe Green is on the Vaad Hazniyas in Monsey, he has been seen on many occasions sitting  in a van driven by Mendy Greenwald  outside the 7 Eleven (a hangout) on College Road looking to see who enters the shop...and then having Mendy harrass them afterwards. He is now defending a convicted child molester!! 
2. Rabbi C.F. Schnaybalg is also on the Vaad... but he finds no problem defending Weingarten.
3. Again, the Appellate Court did not remove 10 years from his sentence, the sentencing was sent back to the Judge and it more than likely that he will keep the 30 years.
4. I would also pray for Weingarten, Yisroel Moshe ben Liba, that he comes to his senses and apologise for the hurt he  caused and  ask his daughter forgiveness..so they all can have closure.
5. I would especially pray for his daughter Fruma Leah Bas Feigah whose youth was robbed, and her future destroyed!
6. The Yiddish newspaper Dee Zeitung is deliberately misleading and lying to its readers .

Leo Weingarten, who is Israel Weingarten’s younger brother, prepared a statement to be read at the end of Israel’s sentencing hearing, in support of his niece - the victim.

Below you will find my victim impact statement, which on Friday I attempted to deliver in open courtroom, before the Court, however, as the Judge explained in open court that my molestation was far removed from this case; therefore, he ruled that I could not make the statement, regardless to the judges ruling please indulge me, and allow me to enlighten you as to why I did go in front of the Court to confront Yisroel Moshe (YM) and what I would have said to the court if the Judge ruled in the prosecutions favor.

Preface

Let me categorically state that I unconditionally love everyone in my family, regardless of their specific acts, or on which side of this disagreement they aligned themselves, for a long time I looked fondly on this quote by James Baldwin: “I imagine one of the reasons people cling to their hate so stubbornly is because they sense, once hate is gone, they will be forced to deal with pain”. In this unfortunate case, this quote fits like a glove and I know in my heart, and I believe with all my soul that some family members are petrified to deal with the real source of their pain.

Premise

Please allow me to explain my premise, that without having firsthand knowledge I certainly did not witness the litigated incestuous pedophiliac attacks. Nevertheless, without a doubt, I believe that YM molested this victim because of the incestuous pedophiliac attacks on me by YM he positively attacked me repeatedly. I am not going to argue the Halacha, nor am I putting myself forward as a Posik, or even a Ben Torah and I am not interested in Pilpul as this is not the place for Pilpul I am only paying attention to facts. Therefore, if you are going to debate my basis and attempt to crack my foundation- good luck your hardened views of YM was set in stone long before you even heard any whispers of the molestation. Moreover, if it does not matter to you, how much evidence the DA put forth during the trial, and you still cling to your assertion that you did not see any evidence, please do not expect any reply from me, it would be pointless to be nitpicking with you and seen picayune.

Now that I established my foundation, you need to understand what underpinning logic I used, in my decision to make the statement, the following principles, should help you understand why I actually traveled all the way to New York and made the statement before the court; the principles are not in any particular order.

Principles

One - the victim, who am I to deny justice for the victim? My inaction would provide the naysayers with one more attack on the victim, i.e. nobody came forward and testified that YM violated them too, furthermore, if I did not come forward, the family would construe my inaction as if I did not believe the victim I just cannot live with that burden for the rest of my life.

Two - the victim needs closure so the healing could begin, all the professionals who deal with victims of sexual molestation on a daily basis say that, to heal a victim, it is indispensable to get closure and part of closure is essentially to confront the attacker.

Three - it is not for the faint-hearted to go into Court and make a statement in front of a judge particularly, if, you have grown children who comprehend and are fully aware of the accusations and counter charges being heaped at each other. It is understood that unquestionably, this family schism is not the way you want to inspire human decency and family values into your children.

Four - in the future, what would I tell my own children or grandchildren - or even worse - on Judgment Day, what would I answer to God? Sorry, I did not sufficiently care about my own family that I deliberately decided to look the other way and just ignore what God, and I know is the truth, or even worst, God-forbid, align myself with the aggressor? Nor can I or will I shirk my parental responsibility. It is the responsibility of each parent to teach and guide his or her children how to behave and under no condition could I or should I be indifferent to my parental responsibilities.

Five - when we talk about molestation, we are talking about the deliberate destruction of the human soul for personal indulgences, and by God, let this conviction be a calling card to all the frum communities that we must stop hiding behind the curtain of religion and confront molestation, that we will not tolerate it, nor will we look the other way. Moreover, if by making a statement in court or posting this on the net, I help only one-victim to speak up or seek help they desperately need-Dayenu.

Six - what about my pain not only was I molested by YM, but the pain for each of the victims grows every day as YM’s defenders, facetiously claim that the only reason his children and I are accusing him, is, for some unexplained precarious reason. Alternatively, we just fabricated the charges because we differ with his theological interpretations and, somehow, I just want to get even with YM, it begs the question, even for what?, and why YM, why not my other brothers?, they have the same beliefs as YM, this pretext is the 21st century blood-libel, in the end of the day, YM is in this predicament only because of his own despicable actions for personal gratification.

Seven - any defender who are willing to espouse that the victims are not trustworthy in God eyes, due to religious divergences, need to look into their own heart and evaluate were he/she stands with God, and stop advancing the idea that you know what God wants and who is a good Jew, while simultaneously you turn a blind eye, while defending a child molester. It behooves us to judge Jews of any affiliation or no affiliation at all, what is in their heart, do they love another Jew, moreover do they hate another Jew so intensely, that they are willing to blatantly lie and commit perjury, (subject themselves to incarceration) and point a finger at their own family member, and accuse him with horrific crimes against minors? Defenders, you ought to learn from Daniel Pearl RIP who was not religious, how proud he was to say, “I am Jewish”, when he knew that would be his last words, what were Daniel’s last words, before Al-Qaeda butchered him? “My mother’s Jewish, my father’s Jewish, I’m Jewish”. Eight - any defender, no matter under what pen name you hide behind, when you write one of your brazen excuses you’re enabling another molester to continue his aggression on innocence’s. Furthermore, this minute in your community, numerous victims are watching these proceedings and wondering - if I speak up or seek help, will I be treated with the same contempt as the victim in this case? You ought to do some soul searching on what effect you have on theses broken souls, I will not evade my moral responsibility to speak up, and by this means, help other victims in need.

Kelley Williams-Bolar was convicted of lying about her residency to get her daughters into a better school district.

Rabbi Wants to Lower Marriage Age to 15!

"Girls who do not want to study or work are a burden to the household," Rabbi Idan noted, "In my opinion, these young people will contribute more to the State because they won't go to nightclubs or waste their time looking for nonsense someplace else."

Currently the age of marriage allowed by law is 17, and according to the initiators of the bill, lowering it by even one year would pose a significant difference.

The Center for Science in the Public Interest describes listeria as due to poor sanitation on work surfaces. The disease has a higher mortality rate (25%) than salmonella (1%), and has been known to affect raw and smoked fish, as in this case.It is also caused by lack of refrigeration of produce below 39 degrees, and by a lack of using pasteurization (heat) to kill the pathogen. 

Ossie’s Schmaltz Herring is packed in a 12 oz plastic container coded 2/0311. It is a product of USA. Product was distributed throughout New York State.

Weingarten Gets One Count Thrown Out On Appeal!

A perverted Hasidic rabbi who sexually abused his daughter throughout her adolescence could get 10 years knocked off his sentence under terms of an appeals court decision this morning.

Israel Weingarten was improperly convicted on one count involving incest that occurred during a trip from Belgium to Israel, the U.S. Second Circuit Court of Appeals in Manhattan ruled.

The following is from a Weingarten supporter who sounds like a lawyer:

Anyone who has carefully analyzed this case would realize that this Weingarten character is a devilish, arrogant, conniving, diabolical, scheming, sadomasochistic, psychopathic monster. He perpetrated his abuse in full view of the public over the course of many years. He contrived elaborate schemes as cover stories as to why he is doing what he is doing, and why his daughter would "lie" about him. Many years ago he already pre-recorded alibi tapes and set up elaborate dramatic incidents that should later serve as alibis for him. This case is suitable for a plot twisting Hollywood movie, a horror movie at that.

At the trial, where he arrogantly acted as his own lawyer, he claimed as a defense that the victim's motivation was to abandon her religion and that she was getting back at him for giving her a hard time about it. He further claimed that as a teenager she had sex with: a neighbor in Antwerp, her older brother and her mother!

If the Rabbis were smart they would let this case die from the headlines rather than to stir it up now. It will not be pretty for anyone if this hits the fan.
Although I have come to a conclusion about this monster’s guilt, there are still intriguing facts about this case which continue to perplex me. At the core of this case is a matrimonial controversy. So as they say, there is his version, her version and the truth.

1) Why did the family court in Rockland find him to be the ideal parent and award him sole custody of the kids during his divorce?

2) What is with those tapes of his ex-wife speaking in slobbering Yiddish with her sister regarding men she would like to sleep with, and with her daughter (the victim) about shaving her privates?

3) Why did the Feds conduct such an extensive 5 year investigation with extensive resources for crimes which were committed on other continents (mostly Europe), using an obscure law?

4) How was it possible for Weingarten to prevail at the Din Torah in Belgium which was conducted by pretty reasonable people there, even though the story was ongoing at the time?

5) Why do the rest of his children, to this day, swear their loyalties only to their father and still refuse to have anything to do with their mother or sister?

6) Why did he receive such a harsh sentence for a crime that by all accounts did not involve actual intercourse? Technically he got 30 years for transiting JFK Airport with his daughter.

Some additional trivia I find intriguing:

- Weingarten's older brother Leo left the fold decades ago, before it was the "in" thing to do. He has had a checkered past since then being implicated in financial misdeeds in Florida. He is one of the driving forces against his brother.

- The ex-wife who played the role of innocent victim all long ended up remarrying a Rosh yeshiva in Monsey who was one of her supporters. He sent her packing soon after the marriage and has now changed his mind about her.

- The victim has taken residence, together with her African-American boyfriend, in Florida, in close proximity to her uncle Leo.

- Not that it means much, but Weingarten happens to be a brilliant torah scholar by all accounts.

I have come to the conclusion that the entire cast of characters in this saga (Israel, his ex-wife, older brother Leo, Oldest son Yoni, Daughter (victim), supporting rabbis, detracting rabbis, etc..) are more complex than they seem and that there are various motives at play.

Though I find many aspects of this case intriguing and mysterious, there is no question in my mind that Weingarten is a hideous monster who got what's coming to him. - Just for the way he conducted the trial alone he deserves to rot in jail for ever.

The Ashkenazi ultra-Orthodox journal Yated Neeman launched a direct attack on Rabbi Ovadia Yosef, an adjudicator of religious law and spiritual leader of the political party Shas, over his decision to confirm that conversions to Judaism performed by military rabbis are legal from a religious standpoint.

The Yated Neeman article quotes anonymous senior judges and rabbis that attack Rav Yosef's decision, saying that IDF conversions are the very opposite of what is required according to religious law. Yated Neeman is considered to be the personal mouthpiece of the Lithuanian Haredi Rabbi Yosef Shalom Eliashiv.

So, now we cannot have any normal Halachic disagreements anymore ...if the Yated doesn't agree with Harav Hagoen Ovadia Yosef, then they attack in the newspapers..... is this our Torah???
