Harav Hagoen Yosef Mograbi from Holon Convicted of Sexual Assaults on his Talmidim

 

Rabbi Yosef Mograbi from Holon who was convicted of a sexual assault on his students - was sent to one year in prison and will pay 100 thousand shekels in damages. 

Teens who were victims testified of persecution by the community.

 The court allowed us publish the hard evidence against him.

From the verdict:

"The defendant called two of the students of the sitting to his office or to the basement floor of the sitting and instructed them to strip their clothes and stay with only underwear, while standing as their bodies are only underwear, the defendant instructed them to fight each other claiming that this is to subdue the level of pride of each of them".

Among other things, during recess he  coersed his students to perform various acts claiming that it was a religious ritual and when the students followed his instructions, the accused watched them and touched himself. Mugrabi presented to his students that the purpose of the said actions is religious-spiritual, when in fact they were meant to satisfy their sexual pleasure.

The sentence states that "While staying in the office of the accused, the accused instructed the student to strip his clothes from his upper body and apply water and oil on his chest, abdomen and hands, then instructed the pupil to stand still in the spirit in water and oil, say holy names or meditate on holy words according to the accused's instruction, in other cases from the accused's spirit The water or oil on the chest of his students.

In one of the cases it was written that "the accused was sitting in his office and still watching through a screen when they were holding the ritual of smelling the oil the accused touched his genital organs for provocation, satisfaction or sexual contempt"

הרב יוסף מוגרבי מחולון שהורשע בהסדר טיעון בפגיעה מינית בתלמידיו - נשלח לשנת מאסר אחת וישלם פיצויים של 100

 אלף שקלים. נערים שנפגעו העידו על רדיפה מצד הקהילה ועל צורך להתרחק מבני אדם. בית המשפט התיר לפרסם את העדויות הקשות נגדו, מתוך גזר הדין:

"הנאשם קרא לשניים מתלמידי הישיבה אל משרדו או אל קומת המרתף בישיבה והורה להם לפשט את בגדיהם ולהישאר עם תחתונים בלבד, בעודם עומדים כשלגופם תחתונים בלבד, הנאשם הורה להם להיאבק זה בזה בטענה כי יש בכך להכניע את מידת הגאווה של מי מהם".

בין היתר הנחה מוגרבי את תלמידיו לבצע פעולות שונות בטענה כי מדובר בטקס דתי ובעת שהתלמידים מילאו אחר הוראותיו, צפה בהם הנאשם ונגע בעצמו. מוגרבי הציג בפני תלמידיו כי מטרתן של הפעולות האמורות היא דתית-רוחנית, כשלמעשה נועדו לשם סיפוקו המיני.

בגזר הדין צוין כי "בעוד שוהים במשרדו של הנאשים, הורה הנאשם לתלמיד לפשוט את בגדיו מפלג גופו העליון ולמרוח מים ושמן על בית החזה, בטן וידיו, לאחר מכן הורה לתלמיד לעמוד בעודו מרוח במים ובשמן, לומר שמות קודש או להרהר בדברי קודש על פי הוראת הנאשם, במקרים אחרים מרח הנאשם בעצמו את המים או השמן על בית החזה של תלמידיו".

באחד המקרים נכתב כי "הנאשם ישב במשרדו ובעודו צופה באמצעות מסך כשהם מקיימים את טקס מריחת השמן נגע הנאשם באיבר מינו לשם גירוי, סיפוק או ביזוי מיני"
